Your CCPA Rights

Subject to certain legal limitations and applicable exceptions, California residents may exercise the following rights.

  • Right to Know. You have the right to request that we disclose to you the categories of Personal Information we have collected, used, disclosed and sold about you in the preceding 12 months, the categories of sources from which we collected the Personal Information, the purposes for collecting the Personal Information, and the categories of third parties with whom we have shared or sold your Personal Information.  You may also request information about the specific pieces of Personal Information we have collected about you.

  • Right to Delete. You have the right to request that we delete your Personal Information that we have collected from you, subject to certain exceptions.

  • Right to Opt Out of the “Sale” of Your Personal Information. Weatherbeeta may disclose certain Personal Information about you for purposes that may be considered a “sale” under the CCPA. For example, we may disclose Personal Information to business partners that have placed cookies on our Websites and advertising technology companies. You have the right to opt out of this “sale” of your Personal Information.

Under the CCPA, you also have the right not to receive discriminatory treatment from us as a result of your exercising these rights.

How to Exercise Your Rights

You may exercise your rights under the CCPA by either:

  • emailing us at info@weatherbeeta.com;
  • calling us at (800) 253-0852;
  • submitting a request form found here

You may also designate an authorized agent to exercise these rights on your behalf by following the process described in “Authorized Agents,” below.

You may request access to your Personal Information twice in any 12-month period, measured from the date we receive your first request.  If you submit a request to obtain your Personal Information more than twice in any 12-month period, we will either: (i) proceed with honoring your request; or (ii) deny your request in writing.

Verification

In order for you to exercise your CCPA rights, we will need to obtain certain information from you to verify your identity.

For a report of the specific Personal Information we have collected about you, you must provide us with three of the following pieces of information in order for us to verify your identity:

  • full name;
  • email address;
  • mailing address; or
  • previous Weatherbeeta transaction ID.

You also must provide us with a signed declaration, under penalty of perjury, that you are who you say you are.

For a report of the categories of Personal Information we have collected about you or for a request to delete your Personal Information, you must provide us with two of the above-referenced pieces of information in order for us to verify your identity.

We do not impose verification protocols for processing California residents’ requests to opt out of the “sale” of their Personal Information, unless we have reason to question the authenticity of a requester’s identity, in which case we may request a notarized affidavit affirming their identity and California residency.

To the extent possible, we will use our existing account authentication practices to verify your identity. Where necessary, we may request additional information about you so that we can verify your identity. Where we did not already hold that information, we will use it only for the purpose of verifying your identity and to process your request.  If you are submitting a request on behalf of a household, we will need to verify each member of the household in the manner set forth in this section.

Authorized Agents

California residents can empower an “authorized agent” to submit CCPA requests on their behalf through the same means outlined above through which a California resident may file a request. Unless the California resident has provided the authorized agent with a power of attorney under the California Probate Code, we will also require the following before processing a request submitted via an authorized agent:

  • signed authorization from the consumer permitting the authorized agent to submit CCPA requests on their behalf;
  • proof of the consumer’s identity sufficient to satisfy our verification process that otherwise applies to CCPA requests; and
  • direct confirmation sent from the consumer to us (without the authorized agent as an intermediary) affirming that the agent is authorized to act on their behalf.

We will respond to Right to Delete requests and Right to Know requests within 45 calendar days, unless we need more time, in which case we will notify you and may take up to 90 calendar days total to respond to your request.  We will comply with a request to opt-out as soon as feasibly possible, but no later than 15 business days from the date we receive the request.

Financial Incentives

We may from time to time offer discounts, coupons or other offers to consumers who provide us with their name and email address.  Such offers are considered “financial incentives” under the CCPA.

In addition to using such information to provide offers to you, we also use the Personal Information we collect from you to provide you with our newsletter and other relevant messaging. These financial incentives are reasonably related to the value of the Personal Information you provide.

The value to our business of any consumer’s Personal Information is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any coupons, discounts or other offers that we make available and the expenses we incur in offering them.

By signing up for our newsletter on our Website, you are opting in to these financial incentives.  You can unsubscribe from our offers, newsletter and other communications at any time by emailing us at info@weatherbeeta.com or by clicking the “unsubscribe” link in any of our emails.
